1. SUBJECT
1.1. These Terms of Use govern the access of users to the electronic portal (Website) located at the web address https://www.naromiart.com/, called “Naromi Art” for short. The Terms also include the Privacy Policy of the Site.
1.2. By accessing and using the Website, the User agrees to comply with these Terms of Use and Privacy, as well as all applicable laws of the current legislation of the European Union and the Republic of Bulgaria.
1.3. You agree not to reproduce, distribute, sell, resell or use for any commercial purpose the content of the Website.
1.4. You agree not to interfere with or disrupt the Website’s services, security systems or content.

4.CHARACTERISTICS OF Naromi Art
Naromi Art is available at the Internet address https://www.naromiart.com/, through which Users have the opportunity to enter into contracts for the supply of works of art, including the following:
4.1. To make inquiries and receive information about the orders placed and their status by exchanging electronic correspondence between artistlady@naromiart.com and the email address specified by the User.
4.2. To make orders (make electronic statements) in connection with the conclusion or execution of the contracts under article 4.1 through the interface of the artistlady@naromiart.com page, available on the Internet;
4.3. To make payments in connection with the concluded contracts with Naromi Art, according to the payment methods supported by Naromi Art – ePay and Revolut.
4.4. To receive information about new products and services offered by Naromi Art;
4.5. To receive information about products and services, their characteristics, functionality, prices and delivery conditions;
4.6. To be notified of the rights arising from the law through the Naromi Art website interface.
5. USE OF THE SITE https://www.naromiart.com/
5.1. In order to use Naromi Art to conclude contracts for the supply of works of art, the User should provide a contact email.
5.2. By making an inquiry or by directly placing an order, the User declares that is familiar with these general conditions, agrees with their content and undertakes to unconditionally comply with them.
5.3. Naromi Art confirms the order by sending an email to the email address specified by the User.
5.4. The electronic address provided by the User for contact, as well as any subsequent electronic address used for the exchange of statements between the User and the Provider, is the “Primary contact electronic address” within the meaning of these general conditions. The User has the right to change his Primary Contact Email Address.
5.5. Upon receipt of a request to change the primary contact email address, Naromi Art sends a request to confirm the change. The confirmation request is sent by Naromi Art to the new primary contact email address specified by the User.
5.6. Naromi Art informs the User about the change made, through an email sent to the main contact email address specified by the User before the change is made.
5.7. The Provider is not responsible to the User for an illegal change of the main contact email address.
5.8. The delivery of a purchased work is carried out after payment by the User of the work purchased by him through the payment methods supported by Naromi Art – ePay and Revolut.
6. RELEASE OF LIABILITY
6.1. Works on the Naromi Art website are identified by title, dimensions, materials used and year of creation of the work. Each work is accompanied by a certificate and signature.
6.2. Naromi Art makes no warranties, express or implied, and hereby disclaims and disclaims all other warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights.
6.2. In no event shall Naromi Art be liable for any damages (including damages for lost profits or business interruption) arising from the use or inability to use the Website. Because some jurisdictions do not allow limitations on implied warranties or limitations on liability for consequential or incidental damages, these limitations may not apply to you.
6.3. Naromi Art has not reviewed all of the sites linked to this website and is not responsible for the content of any such linked site. The inclusion of a link does not imply endorsement by Naromi Art of the site. Use of such linked website is at the User’s own risk.
6.4. Naromi Art may, at your express request, send you e-mails with news that it introduces to the website related to your interests as a form of direct marketing.
7. INTELLECTUAL PROPERTY
7.1.The materials contained in Naromi Art are protected by the Copyright and Related Rights Act, the Trademark and Industrial Design Act and applicable copyright and trademark laws.
7.2. License to use
All photos of works from the Naromi Art website are for personal viewing only. Downloading or obtaining images from a work does not transfer ownership of those images and the work, and under this license, you may not:
– to modify or copy content and photos from Naromi Art;
– use content and photos from Naromi Art for commercial purposes or for public display (commercial or non-commercial);
– attempt to decompile or reverse engineer any software contained on Naromi Art‘s website;
– to remove copyright notices or other notices from the works; or
– transfer even partial content of the Website to another person or create a “mirror version” of the Website on another server.
7.3. This license shall automatically terminate if you violate any of the restrictions listed in item 7.2 and may be terminated by Naromi Art at any time. When you have finished viewing these materials or upon termination of this license, you must destroy all downloaded materials in your possession, whether in electronic or hard copy format.
8. PRIVACY POLICY
8.1. Naromi Art implements all measures to protect the personal data of natural persons, which are prescribed by the legislation of the European Union and the Bulgarian legislation.
8.2. Personal data is any information that can be used to identify a natural person, directly or indirectly.
8.3. When placing orders, Naromi Art may collect some or all of the listed data for Users: name, surname, telephone, e-mail, city, address, bank account details when sending requests to purchase works.
8.4. Naromi Art does not collect sensitive personal data (such as race, political views, health information and biometric data, etc.).
8.5. The legal basis on which Naromi Art processes the personal data of the Users is solely in connection with the negotiation of possible orders for the purchase of works and/or for the fulfillment of its obligations pursuant to an already placed order.
8.6. Consent to the processing of personal data is provided by the User when placing an order and can always be withdrawn by sending a letter to the email specified in these Policies – artistlady@naromiart.com .
8.7. The personal data received by the Users are used only for the purpose that Naromi Art can fulfill its obligations under the contract, because without them it is not possible to provide the work in which the User is interested.
8.9. More specifically, the processing of personal data includes the following purposes:
– to send the works offered by Naromi Art;
-to respond to Naromi Art inquiries, opinions and recommendations;
– to send by Naromi Art information to Users related to special campaigns and new products and services;
– for accounting purposes when fulfilling contractual obligations of Naromi Art.
8.10. Personal data is stored by Naromi Art on a contractual basis, i.e. for the fulfillment of contractual obligations and in this case the storage period is 5 years from the termination of the contractual basis. After the expiration of this period and in the event that there is no legal basis for continuing the storage of personal data, the information is destroyed.
9. CHANGES TO THE TERMS OF USE OF THE SITE
9.1. Naromi Art may revise these Terms of Use for its website at any time without notice.
9.2 When you use this website, you agree to be bound by the current version of these Terms of Use.
10. GOVERNING LAW
10.1. All claims and disputes related to the Naromi Art website shall be governed by Bulgarian and EU law regarding the national jurisdiction of Naromi Art.
10.2. In the case of disputes, ways will be sought for their voluntary settlement, and if it is impossible to achieve such a solution – according to the Bulgarian courts.
